Terms & Conditions

The boring-but-important bit. Plain-English where we can, lawyer-talk where we have to. By signing up to Nichy AI you're agreeing to the rules below. If anything's unclear, email info@nichy.ai and we'll explain in real words.

1. Who we are

Nichy AI ("Nichy", "we", "us", "our") is an online learning platform that helps UK pupils in Years 3–6 prepare for primary school and 11+ entrance exams (GL, CEM, SET). Nichy AI is provided by the team behind nichy.ai. You can reach us any time at info@nichy.ai.

These Terms & Conditions form a legal agreement between you (the parent or guardian, referred to as "you" / "your") and Nichy AI. By creating an account, signing in, or using any part of the service you confirm that you have read, understood and accept these Terms and the Privacy Policy.

2. Accounts and who can use Nichy AI

Accounts are created and held by a parent or legal guardian on behalf of a child aged 7–11. Children must not register their own accounts; the parent account creates a child sub-account and shares the login with the child.

You're responsible for keeping your password (and your child's password) safe and for everything that happens under your account. If you suspect unauthorised access, please email us straight away.

We may suspend or close an account that breaks these Terms, abuses the AI tutor, or risks the safety of other users.

3. Subscription, pricing and free tier

Many parts of Nichy AI are free to use. Premium features (e.g. AI Marker for written work, full timed mock papers, unlimited AI Tutor, weekly progress reports) may be offered on a paid subscription basis from 1 June 2026. Pricing, billing terms and cancellation terms will be shown clearly on the checkout page before payment.

All subscriptions auto-renew at the end of the billing period unless cancelled. You can cancel at any time from your parent dashboard; cancellation takes effect at the end of the current billing period.

Refunds are handled in line with UK consumer law. If you change your mind within 14 days of the first paid subscription, contact us for a full refund — provided you haven't already used a substantial portion of the paid features.

4. How the AI features work

Nichy AI uses large-language models and other automated systems to mark written work, explain answers, generate practice questions and produce progress reports. These systems are best-effort tutoring aids — they're not a substitute for a teacher, school, or formal exam moderation. Marks and explanations may sometimes be incorrect, especially on edge cases.

We ask parents and children to use Nichy AI as a learning tool, to question its output, and to flag mistakes via the in-app feedback button so we can improve the system.

You agree not to use Nichy AI to generate content that breaks the law, harms others, infringes copyright, or that you'd reasonably consider unsafe for a 10-year-old.

5. Acceptable use

You and your child agree not to:

• upload anything you don't have permission to share, or content that infringes someone else's rights;

• reverse-engineer, scrape, or attempt to extract our question banks, AI prompts, or training data;

• use the AI tutor for non-educational purposes, abusive content, or anything that could harm children;

• share your account credentials, attempt to access another family's account, or interfere with the service.

6. Content, intellectual property and your data

Nichy AI's question banks, practice papers, branding, code, AI prompts and progress-tracking algorithms are owned by us. We grant you a personal, non-transferable licence to use them for your child's home-learning while your account is active.

Work your child uploads (handwritten answers, typed essays) belongs to your child. By uploading you give us permission to process it through our AI Marker and store it on your dashboard. We don't sell your child's work, and we don't use it to train third-party AI models without your explicit consent.

7. Disclaimers and liability

We provide Nichy AI "as is" without warranties of any kind. We don't guarantee specific exam outcomes — passing the 11+ depends on many factors outside our control.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by negligence, or any liability that can't be limited by UK law.

Subject to the line above, our total liability to you (whether in contract, tort or otherwise) is limited to the amount you've paid us in the 12 months before the event giving rise to the claim, or £100, whichever is greater.

8. Changes to these Terms

We may update these Terms from time to time as we add features or to reflect changes in the law. We'll email you at least 14 days before any material change takes effect. If you don't accept the new Terms, you can close your account before they come into effect.

9. Children's online safety

Nichy AI is designed with the UK Children's Code (Age-Appropriate Design Code) in mind: no behavioural advertising, no third-party trackers in the child area, no public profiles, and chat between users isn't supported.

If you're ever worried about your child's safety while using Nichy AI, contact us immediately at info@nichy.ai. We have a clear safeguarding policy and respond within one working day.

10. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be handled by the courts of England and Wales, although as a consumer you may also be entitled to bring proceedings in your home country.
